Acceptance procedure

On receipt of a deposit (or full payment) and a complete and signed or e-mailed booking form, Ski the Edge will endeavour to book the accommodation and if it applies, the associated transport.  When/if this is achieved an invoice will be sent to you. The details of your booking are specified on the invoice.  If anything is wrong or you wish to make any changes this/these must be brought to the attention of Ski the Edge within 10 days of the date of the invoice.   Thereafter a contract exists, subject to the booking conditions and any specific notes shown on the invoice, between Ski the Edge and yourself. The transport company concerned (if any) will undertake to provide the transport, subject to their conditions and the accommodation concerned will undertake to provide the holiday (as described in this brochure and any other literature produced about it) that has been reserved by Ski the Edge on your behalf.

The Principals concerned assume no responsibility for the contents of the information in this publication. Clients are advised to read the relevant company’s own brochure.  Their conditions must be adhered to.  If your ferry crossing has been booked by Ski the Edge any changes to your crossing details must be made for you by Ski the Edge.
Brochure Accuracy and of any other information supplied by Ski the Edge
Any information about accommodation or a resort is based on a previous season’s visit by Ski the Edge or on information supplied by the accommodation or resort and Ski the Edge cannot be held responsible if changes have taken place by the time of your holiday.
Insurance
All persons must have ski holiday insurance. Persons, who do not avail themselves of the Fogg insurance provided by Ski the Edge, must obtain equivalent insurance from elsewhere.  It is your responsibility (or parents or group leader in the case of persons under 18) to ensure you have insurance of this standard. If you purchase Fogg insurance you will should receive a policy document and a medicard with your invoice.  This is your proof the insurance is in place and it is your responsibility to check this. You must read the policy document to be familiar with its conditions and the cover it provides.  You may cancel it within 14 days (time permitting) if it is not to your liking and obtain other insurance. If you have an annual insurance policy, check it covers winter sports. It is your responsibility to notify the insurers of your trip to activate your cover for winter sports if this is a requirement of your annual policy.  Ski the Edge will accept no responsibility for the consequences that could follow from a failure by the client to comply with all these conditions relating to insurance.
European Health Card
All British and EU persons must obtain a European Health Card and take it on the holiday.
Loss and Injury
You (or in the case of minors your parents) must realise that winter sports, and the peripheral activities and necessities associated with a winter sports holiday, can be dangerous and you participate at their own risk. Possible consequences of these dangers cannot be attributed to Ski the Edge or any accommodation or transport provider or anybody acting on their behalf.
Peter Edge, his daughter, the coach drivers, anybody acting as courier, any other helper or youth hostel staff are not ski, snowboard or mountain guides or instructors and just go on the slopes in the company of others for their own enjoyment. If you (or your children) join them on the slopes, even if you are less experienced, you do so as a leisure time companion at your own risk.  Furthermore advice given by these people would not be qualified and would relate only to enjoyment and NOT to safety.  Safety advice should be sought from the local ski school or ski patrol by you yourself particularly before going off-piste.
Furthermore you should also realise that the dangers of falling, particularly due to ice outside, or due to wet floors in buildings or the wearing or carrying of winter sports equipment, or the perils of getting cold are present away from the slopes as well and you (or in the case of minors your parents) must accept such dangers as wholly your own risk.
Furthermore you should also realise that there is a danger of falling and/or injury, if you undo your seat belt and leave your seat on a coach which you do wholly at your own risk.
Any belongings that are with you on the holiday are you own responsibility and no blame or compensation can be expected of Ski the Edge, the accommodation or transport companies, if there is any loss or damage.

Documents

All persons must have their own passport valid to well beyond the end of the holiday, which must be taken with you on holiday. Non EC passport holders may require a visa and you should check yourselves, in good time before the holiday, if this is required.
All persons booking a holiday to stay in a Youth Hostel, must be, or must become, prior to departing on the holiday, a member of the youth hostel association of that person’s country of residence. The membership card must be taken with the person on the holiday, to present to the youth hostel staff on arrival.  Please note that the leaders of official groups with a proper membership and committee structure may apply for a group membership of the YHA, which will make individual membership unnecessary.
You must remember to take on the holiday with you, any tickets and code numbers that are issued, your insurance documents and European Health Card (note: valid in Switzerland)

Currency Variations

Ski the Edge reserves the right to charge a supplement for package prices given in £s, if the tourist rate of the £, as specified on Ceefax, drops below 1.35 Euros to the £ for Eurozone holidays and 2.05  Swiss Francs to the £ for Swiss holidays.  Persons booking without transport from the UK are invoiced in £s, converted on the day of invoicing, from the advertised price in Euros.  The exchange rate used will be the tourist rate, as displayed on Ceefax, on the day of invoicing.  The price shown on the invoice will then remain fixed.

Cancellation by you and refunds or charges
Persons cancelling their holidays must do so by both telephone and in writing. If a suitable replacement (as described below) is found, either by yourself or Ski the Edge and the replacement is paying the same price for the holiday, then this will count as a name change as detailed below. Ski the Edge, at its discretion, will return money recovered from its suppliers, less out of pocket expenses.  Otherwise the scale of charges for cancellation will apply:
More than 30 days before departure,                            loss of deposit.
Between 30 and 8 days before departure                     50% of the cost of the holiday.
Between 7 days and 24 hours of departure                 75% of the cost of the holiday.
Less than 24 hours of departure and ‘no show’       100% of the total cost.
An insured person eligible for a cancellation payment from an insurance company will not be able to claim for that part of any claim that has been refunded by Ski the Edge.

Changes by the client

booking conditionsName changes A booking may be transferred, to a person able to sleep in the same bed booked by you and who will use the same transport.  However the insurance of the original person will be forfeited and a fresh policy must be bought by the new person.  If the change is less than 8 days prior to the start of the holiday, then the replacement person must take on the exact details of the original person and pay the same money regardless as to whether some items are wanted. Changes where the same bed would not be appropriate or where different transport will be used will count as a cancellation.
Change of week or accommodation These are counted as a cancellation of the holiday originally booked.
Change or cancellation of equipment hire or lessons
The procedure for pre-booking equipment hire or lessons on Ski the Edge holidays varies from resort to resort.  Please read the information in any information leaflets, website or Ski the Edge brochure to see which system applies.  If pre-booking applies, this must by done on the booking form at the time of booking the holiday. You may cancel your booking of these extras only when you pay your final balance. Please explain this if your final money doesn’t match up with the money indicated on your invoice. This will have involved you in no financial outlay.  No additions to your booking can be made at this stage.  If you don’t book these items when you book the holiday, or wish to make changes later on, then Ski the Edge cannot help you.  You must sort out your own requirements.
Cancellation or changes by Ski the Edge
Ski the Edge will have acted in good faith to provide the holidays described and booked by the client, but if changes with the arrangements have to be made, then Ski the Edge will endeavour to put alternative arrangements in place or offer a complete refund of all monies paid towards the holiday in question, plus the cost of insurance specific for the holiday in question.  Under no circumstances will any further money or compensation be paid.
1) Cancellation of hired coaches due to uneconomic numbers
Ski the Edge reserve the right to cancel the provision of a hired coach and choose to provide, offer, or suggest, alternative transport.  This will happen if it looks as if the numbers booked on the hired coach will be less than 30 persons or if the accommodation becomes not available for such numbers.  If the cost of the alternative is greater than the original this must be paid for by the client. If you don’t accept the alternative transport, then you may cancel without charge and with all money refunded.  Clients would be offered a complete refund, a change of date of holiday at no extra charge or alternative transport.
2) Accommodation
If, before 15th September 2006 the accommodation becomes unavailable, the holiday will simply be cancelled and all moneys returned and Ski the Edge will have no further obligation.  If, exceptionally, after that date, the accommodation booked becomes unavailable, Ski the Edge reserves the right to cancel the holiday. However every endeavour will be made to offer alternative accommodation. The extra cost of such accommodation must be paid for by the client if the unavailability is as a result of unusual and unforeseeable circumstances amounting to ‘force majeure’ eg fire.  Alternatively the client may choose to cancel the holiday and have all money paid returned (except transport if not part of the Ski the Edge package). If you have already started the stay in the accommodation, any alternative provision will be at be at no extra charge to the client.
3) Transport delays and breakdown
You are expected to put up with any delays caused by traffic, the weather, road conditions, mechanical breakdown, strikes, industrial action, or any other reason and no compensation will be paid if the delay is less than 12 hours.  Any compensation after that is an insurance issue and no payment will be paid by Ski the Edge.  If there is a complete failure of a coach hired by Ski the Edge, then alternative transport will be provided.
House Rules
Persons on the holidays are expected to behave in such a way, so as not to spoil the enjoyment of anybody else. If staying in a youth hostel you must observe the rules and traditions.  Ski the Edge reserves the right to refuse to accept a reservation from any person or group without giving a reason.
Dealing with Complaints
As soon as you realise that something is not as could reasonably be expected please let a representative of the provider eg coach driver, youth hostel or hotel manager know. If things are not put right please let Ski the Edge or a representative of Ski the Edge know. We will try to put things right or come to a compromise acceptable to all concerned.  If, having tried to resolve things at the time, you come back from a holiday and you still feel aggrieved that things didn’t go as well as could reasonably be expected, or wish to make comments or offer advice please write a letter, stating what was wrong. Address to write to: Mr P. Edge, Ski the Edge, Sandstones, Hornby Road, Wray, Lancaster. LA2 8QN.  We will then try to talk about it and hope that things can be resolved.
If, despite our best efforts and having followed the above procedure for reporting and resolving your complaint, you feel that it has not been satisfactorily settled, we recommend that it is referred for arbitration under the ABTOT Travel Industry Arbitration Service.  An Independent Arbitrator will review the documents relating to any complaint and deliver a binding decision to bring the matter to a close.  Details of this scheme are available from either The Travel Industry Arbitration Service (ABTOT),  Old Exchange House, Marford Road, Wheathampstead, Herts. AL4 8AY or from ABTOT, 86 Jermyn Street, London. SW1Y 6JD.  This scheme cannot however decide in cases where the sums claimed exceed £1500 per person or £7,500 per booking form, or for claims which are solely or mainly in respect of physical injury or illness or the consequences thereof.
